Department of Justice of Zhejiang Province

Institutional functions:

 

These provisions are formulated in accordance with “Decisions of the CPC Central Committee on Deepening the Reform of the Party and State Institutions” and “Zhejiang Institutional Reform Programs”approved by the Party Central Committee and the State Council. The institutional functions and main responsibilities of this department are as follows:

 

I. Department of Justice of Zhejiang Province is a department of the Provincial Government and at the departmental level.

 

II. The Office of the Provincial Party Committee for Comprehensively Governing the Province by Law is settled in Department of Justice of Zhejiang Province.

 

III. Department of Justice of Zhejiang Province implements the guidelines and policies, and decisions and deployments of the Party Central Committee and the Provincial Party Committee on comprehensively governing the province by law, and insists on and strengthens the Party's centralized and unified leadership over governing the province by law in the course of performing its duties. Its main responsibilities include:

 

(1) Undertaking study of policies on major issues related to comprehensively governing the province by law, coordinating relevant parties to propose mid- and long-term planning recommendations for comprehensively governing the province by law, and being responsible for the supervision of relevant major decisions and deployments.

 

(2) Undertaking the responsibility of overall planning legislation; being responsible for soliciting suggestions on the formulation of local laws and regulations from the public.

 

(3) Being responsible for drafting or organizing the drafting and review of relevant local laws and draft regulations of the Provincial Government; being responsible for the legal advisory work for the Provincial Government.

 

(4) Undertaking the interpretation of and reply to regulations of the Provincial Government and post-legislation evaluation; being responsible for the filing and review of regulations, administrative normative documents, and major administrative decisions; guiding the clean-up of administrative normative documents.

 

(5) Undertaking the responsibility of coordinating and promoting the construction of governments of rule of law: guiding and supervising administrative reconsideration, administrative response and administrative compensation in the province; being responsible for handling administrative reconsideration, administrative response and state compensation cases.

 

(6) Undertaking the responsibility of overall planning the construction of a society of rule of law: being responsible for the formulation of publicity and education plans for the rule of law, organizing the implementation of the popularization of laws, and organizing publicity of the rule of law to foreign countries; promoting public participation and promotion of the construction of the rule of law; guiding governance by law and the establishment of the rule of law; guiding mediation and the appointment and management of people's jurors and people's supervisors; guiding and promoting the construction of judicial offices.

 

(7) Guiding and supervising the execution of penalties and reform of criminals in prisons across the province; guiding and managing the community corrections in the province; guiding the assistance and education and settlement of the released criminals.

 

(8) Guiding and supervising the administration of judicial and administrative  rehabilitation of drug addicts.

 

(9) Being responsible for formulating and guiding the implementation of plans for the construction of the public legal service system, and overall coordinating and distributing urban, rural and regional legal service resources; guiding and supervising the management of lawyers, legal aid, judicial appraisal, notarization, arbitration and grassroots legal services.

 

(10) Undertaking the organization and implementation of the national legal professional qualification examination in Zhejiang.

 

(11) Guiding and managing the foreign affairs of the judicial system, and organizing and carrying out legal cooperation and exchanges with foreign countries.

 

(12) Being responsible for the management of guns, ammunition, uniforms and police vehicles in the system, and guiding and supervising guarantee work related to finance, equipment, facilities, places, etc.

 

(13) Planning, coordinating, and guiding work related to the building of legal talent teams, and guiding and supervising the staffing of this system; guiding higher vocational education in this system; being responsible for the management and supervision of police affairs in the system; assisting prefecture cities in managing leaders of judicial bureaus.

 

(14) Managing Zhejiang Prison Administrative Bureau and Office of Provincial Comprehensive Administrative Law Enforcement.

 

(15) Completing other tasks assigned by the Provincial Party Committee and the Provincial Government.
